By accessing or using the website located at beverlydeckandfence.com (the "Site"), or by engaging Beverly Deck & Fence ("we," "us," or "our") for any service, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our Site or services. These terms apply to all visitors, customers, and anyone who contacts us through the Site.
Beverly Deck & Fence provides residential deck building, fence installation, and related outdoor structure services in Beverly, Massachusetts and surrounding communities. Services include, but are not limited to, custom deck design and construction, composite and wood deck installation, fence installation, screened porches, pergolas, and deck repair. We do not guarantee availability for any specific project until a signed contract is in place.
Written estimates provided by Beverly Deck & Fence are based on the information available at the time of assessment. Estimates are not binding contracts. Final pricing may change if site conditions, material costs, or project scope differ from what was assessed during the initial estimate.
Any changes to the scope of work after a contract is signed must be agreed to in writing by both parties before the additional work begins. Verbal agreements regarding scope changes are not binding. We will notify you of any potential cost changes before proceeding with work that falls outside the original contract.
Project scheduling is subject to availability, permit approval timelines, weather conditions, and material delivery. We will provide you with a projected start date and timeline at the time of contract signing. We are not liable for delays caused by factors outside our reasonable control, including weather, permit processing delays, or material supply issues.
If you need to cancel or reschedule a project after a contract is signed, please notify us in writing as soon as possible. Cancellation terms, including any deposit forfeiture, will be specified in your individual contract. We reserve the right to reschedule work when weather or site conditions make it unsafe or impractical to proceed.
Payment terms are set out in each individual contract. In general, a deposit is required before work begins, with the remaining balance due upon project completion unless otherwise agreed in writing. Accepted payment methods will be specified in your contract.
Invoices that remain unpaid beyond the due date specified in the contract may be subject to late fees or collection procedures. Title to any materials installed does not transfer to the customer until payment is received in full.
Where required by local building codes, Beverly Deck & Fence will obtain the necessary building permits before beginning work. Permit fees are typically included in the project quote unless otherwise noted. The customer is responsible for ensuring that the property is accessible for any required inspections. Work will not begin until required permits are approved by the applicable authority.
Beverly Deck & Fence warrants that all work will be performed in a workmanlike manner consistent with industry standards. Any warranty terms specific to your project will be set out in your written contract.
Manufacturer warranties on materials such as composite decking, hardware, and fasteners are passed through to the customer to the extent permitted by those manufacturers. We do not extend or modify manufacturer warranties.
The Site and any information provided on it are offered "as is" without warranty of any kind. We do not warrant that the Site will be available at all times or that information on the Site is complete, accurate, or current.
To the fullest extent permitted by law, Beverly Deck & Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or from our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or related to our services shall not exceed the amount you paid us for the specific service that gave rise to the claim.
You agree to provide accurate information when requesting services or submitting a contact form. You are responsible for ensuring that the work area is accessible and that any required clearances (furniture, landscaping, utilities marking) are in place before the crew arrives on the scheduled start date.
You agree to notify us promptly of any concerns during the course of work rather than waiting until the project is complete. Issues raised after project completion and final payment may be treated as new service requests.

These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Massachusetts.
